False Oath in Korean Criminal Law

False oath in Korea is stipulated under the title called "the fault of false oath and obfuscation in art. 152 ff which are regulated in the tenth section of the Penal Code. As it is not compulsory that the crime of false oath may occur when an abstract threat appears, which the false statement will affect the judiciary in its function. False oath constitute a crime serious that could render the whole criminal justice system formalistic. The awareness about problematic of false oath in Korea is therefore noticeable after a task of setting the negotiation concentration has a political core task in the discussion of the legal reformation. It has to be expected that false oath is diminished by the strengthening of the judicial reform and negotiation concentration.
