摘要：
Although there are a considerable number of references to proportionality in the opinions of STF's Justices, it is not right to conclude, basing on this fact, that STF applies proportionality. The application of proportionality in the context of a collegial decision requires the development of an argumentative reasoning which, in turn, depends on the fulfillment of deliberation in the strict sense, which, essentially for reasons of institutional nature, is not the case in the Brazilian's Supreme Court.
