摘要：

The purpose of this paper is to perform a systematic analysis of the process of institutionalization of democracy, the state, morality and law in the West. Habermas concepts in his theory of communicative rationality are examined. Such approaches are part of the theory of communicative action and stated in political and legal terms as facticity and validity.
