SOME CURRENT ISSUES OF COUNTERACTION TO CORRUPTION IN GOVERNMENTAL AUTHORITIES

摘要
The article discovers current issues of counteraction to corruption in governmental authorities in terms of passage and coming into legal force of new laws in 2011-2013. These laws impose innovations into Russian legislation on state service in the Russian Federation. Innovations are intended to counteract corruption in governmental authorities. However, some of innovation have weaknesses and negate the effectiveness of taken actions. What is particularly meant here is a new form of corruption counteraction - monitoring of expenditures against incomes of public servants and others. This action is necessary and approved by society, but it may fail if special steps are not taken. These steps are aimed at filling the vacuum of legislation that lets the guilty escape responsibility. The same is true with application of part 2 of the Article 17 of the Lawon State service in the Russian Federation related to transfer of securities, stocks and assets toconfidential management when entring into service. Because of corruption elements within theapproval procedure and intermittent power of authorities' managers, the target anti-corruptioneffect cannot be achieved by law regulations on employment in lower organization during 2 yearsafter state service. The research studies these and other actions of corruption counteraction anddecisions. The author proves necessity for introduction 2-5 years disqualification as punishmentfor above mentioned anti-corruption law violations instead of discharge. The author states thatdisqualification has been approved and tested in law enforcement activity.
