Regulatory framework of the Special Education in Latin America and the Caribbean and his incident in the Top Education

摘要
This work describes the regulatory framework for special education in Latin America and the Caribbean countries and their impact on the inclusion of people in disability situation in higher education. Also, it determines the attainment of the right for education of any person regardless of their condition by identifying the set of laws. In order to do that, a qualitative methodology was established by using a study case, which considers as an analysis unit the special education systems in various countries of the Region, and as an information unit the regulatory framework (laws), considering this framework as a structural and operational element in higher education. The analysis technique corresponds to a content analysis of the final corpus as a review. This study was conducted in two stages and each one at established times and steps. Among the main findings it is possible to point out the existence of a regulatory framework for the protection and/or recognition of education as a fundamental right, as function of access, permanence and curricular progression of students in disability condition in higher education. This situation is approached from the determination of support measures for inclusion, the role of the State in the process of inclusion of this population, education as a fundamental right, mechanisms of regulation and implementation of regulatory framework, as well as the transit of the compulsory regular education to the higher/university education.
