摘要
This article aims to expose the change in the interpretation of an environmental legislation created during a military dictatorship, as well as the understanding of national security. Previous understanding on the subject was, at first, conceived under the auspices of a military government and then it shifts in a transition to a democratic state. it sets up a new paradigm for National Security as the country's armed forces are now commanded by a civilian president. The ideology of dictatorship was replaced by the one of democracy, which is anchored on human dignity. Environmental resources must keep compatibility with a new concept of national security, as established by Article 91 of the Federal Constitution, which exemplifies the importance of environmental mineral resource as a strategic asset that must be protected, regarding the border and ranges to the defense of the country. Nowadays, there is a new world order that is not being spared of energy-based crises. The creation of a defense industry regarding environmental assets is required.
