摘要
The "Constituicao da Republica Federativa do Brasil" (Brazilian Constitution Letter) assures to all brazilian person, born or not in Brazil, a roll of constitutional guarantees, among those the equilibrated ecological environment is pointed out, such as the health for everyone. By the Public Administration, the State tries to regulate and monitore activities which can interfere on those guarantees. The ANVISA, by the "Resolucao da Diretoria Colegiada RDC nr. 306/04 (Colledged Directory Resolution), stableshed the "PGRSS - Plano de Gerenciamento de Residuos de Servicos de Saude" (Management Plan for Health Services Residues), classifying those residues into 5 groups and defining the procedures for applicable final destination. However only 55,72% of all generated residues in Brazil is correctly treated, not considering that there are no trusted data basis that express statisticatics and information about the level of adhesion from those residues generated organizations to the PGRSS (MPHSR). As a result, the Public Administration is far from to apply the ubique principle, as well as the property and prevention, to the benefit of the commum wellfare and the equilibrated ecological environement.
