The business world and construction industry is undergoing a transformation in how it resolves disputes. This is evidenced by the recent acceptance and burgeoning use of mediation, mini-trials and dispute review boards in the commercial world. These tools have provided the common ground needed by business and construction to head off costly and time-consuming litigation. Their continued use and evolution will shape the future of those industries and of ADR as a force in resolving complex commercial disputes.
