LEGAL MARKET THEORY AND THE ENVIRONMENT PROTECTION

This article presents concerns with the environment protection, in a scenario of economic and technological development, which generates ever more environmental impacts. The analysis of this scenario will lead to the conclusion about the inevitable need of rules that imposes limits to economic agents in order to ensure the achievement of constitutional social goals, thus ensuring the maintenance of human life. The Legal Theory of the Market - economic law - is presented as a tool to be used for the achievement of social objectives, ensuring the balance of the environment, but also the maintenance of economic development in order to build a sustainable development.
