Giorgio Agamben burst into the realm of political theory drawing powerful reflections on biopolitics and, in particular, making a harsh criticism of the abandonment of the legal and political discourse of sovereignty developed by Michel Foucault. In the present piece of work I try to reveal that Michel Foucault's rejection of political and legal discourse of sovereignty was due to historical and methodological reasons. Secondly, I would like to show that Agamben has restored the notion of sovereignty, but without attending to the specific legal practices. Finally, I suggest that the references to sovereignty and law without paying any attention to practices may be caused by the method based on the use of paradigms that Agamben proposes.
