摘要
This article deals with the evolution of the legal norms that serve as a basis for public-private partnership in Brazilian education. From the analysis of documents, literature and research in the area, notes the emergence of partnerships (1990) between the Public Administration and the private sector (profit and non-profit), and the main reasons that support the private sector as the ideal partner of the State. There is also a discussion on the proposals of international organizations regarding the participation of (neoliberal) civil society in the development of public educational policies. In order tounder stand the set of laws that make possible the construction of the public-private partnership in the field of education, we point out those at the national level, through law analysis in the municipality, we high light an institution-alization of the content offered by the partner through normative construction at the local level. The main findings indicate the growth of the regulatory system in relation to the partnerships. We conclude that the current legal framework legitimizes and institutionalizes the content of partnerships serving as a mechanism for the evolution of the public-private partnership. Thus, it is evident that the public-private partnership obscures the antagonism between capital and labor and inequalities become only differences that can be suppressed with the (subjective) effort of each individual.
