In the process of economic development in Yunnan province, small and mid-sized enterprise has occupied an important position. The most of amount of the small and mid-sized enterprise assets is single model. Few tangible assets can be used to guarantee finance. These reasons lead small and mid-sized enterprise to a way which is difficult to obtain the corresponding to its position of financial resources. Financing difficulties has become the primary bottleneck restricting the development of small and mid-sized enterprise in Yunnan province. To solve the financing difficulties of small and medium-sized enterprises, they should be starting from the point of the unique advantages of the enterprise intangible assets. To set the patent right for the media, to give full play to the role of financial instruments, the norms which are from patents to the conversional process of capital, from the legislative point of view to solve the problem of the patent pledge financing. This paper briefly introduces the basic financing situation of SMEs in Yunnan Province patent pledge, based upon the existing legal system. It puts forward suggestions on the technology oriented small and medium enterprises in Yunnan Province patent pledge financing legislation from three aspects of subject. The object and the supporting measures would help improve the technology oriented small and medium enterprises in Yunnan Province patent pledge system.
