ART, MEMORY AND HUMAN RIGHTS: THE MANIFESTATIONS OF THE INTER-AMERICAN COURT OF HUMAN RIGHTS

摘要
The article seeks to demonstrate the interactions of law and art as a mechanism for processes of memory and symbolic reparation in cases of violations of human rights. The logical-deductive methodology and bibliographic review were used to consolidate the research. The analysis took place through research at the Inter-American Court of Human Rights (IACHR) to demonstrate the relevance of art as a potential mechanism for building a collective memory. The following cases were analyzed: Masacre de Mapiripon vs. Colombia; Barrios Altos vs. Peru; and Presidio Miguel Castro Castro vs. Peru. It was noted that, in these cases, the IACHR decided, among other issues, to impose on the States the construction of monuments in honor of the victims in order to create a collective memory. It was concluded that it is necessary to observe the balance between ethical and aesthetic elements, the participation of the victims and that art can be used as a tool of resistance and denunciation of human rights violations.
