CONSIDERING OPEN PRISONS AS ORDINARY PRISONS

We can say that the changes needed by our penitentiary system are basically three. The first and most important is the one dealing with the view of professionals belonging to the administration. It is practically impossible to achieve the aims of art.25.2 CE if the ones in charge of executing the sentence do not believe in them. Secondly, it is fundamental to fight for the implementation of the real meaning of this paragraph. This in the sense of considering therapeutically intervention as a fundamental right of inmates, but also avoiding the use of the concept of special relation towards the administration. Finally, the third change consists on improving the application of open regime as the ordinary and common regime. Only with following this programme we can save the existing gap between reality and possibilities.
