AUTONOMY OF CONFESSIONS AND COMMUNITY LAW: THE PROTECTION OF PERSONAL INFORMATION IN THIS CONTEXT

Article 91 of Regulation (EU) 2016/679, of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, is a good "test-bed" for examining the scope of the principle of the autonomy of religious organizations in European Union law. This paper analyses the regulation and case-law of the principle of autonomy of religious organizations, in European Union law, in relation to the protection of personal data. In addition to this, we study the legal consequences of this European Union regulation in the Spanish law, as well as the legal impact of this European Regulation 2016/679 on the protection of personal data on the internal autonomy of religious organizations that are in Spain.
