Contemporary authors often ascribe an ancient pedigree to the insanity defence. Several of these assert that its origins lay in ancient Greece. This article explores the nature and exercise of Greek law and finds that there is no positive evidence to Support the assertion that the insanity defence was practiced in ancient Greece.
