The Legal Menace and Countermeasures of China's Educational Service Trade under the "One Belt, One Road" Strategy

In the "One Belt, One Road" strategy, China should actively communicate with countries along the international education service trade, the existing WTO service trade rules is the important legal basis. The protocol of China's accession to the WTO in its commitment to educational service is not rigorous, making China's educational sovereignty under menace. Therefore, China should make full use of the existing WTO rules of educational service trade through legal measures and legislative regulation of the indirect control, meanwhile China can use international bilateral investment agreements with countries, through the investment definition" and "non-preclude measures" provisions to safeguard China's legitimate rights and interests.
