摘要
This paper analyses the women's positions in Brazilian urban space, considering the violation scenery on their human rights, presenting the right to the city as a possible alternative to the protection of feminine existence and the accomplishment of their demands. The research is relevant because it shows the necessity of amplification of the reflections in the field of Law, especially nowadays, regarding women's human rights violations in urban environment and in the prism of the right to the city. Women were considered as object of guardianship for a long time by the Brazilian legal system, not as subjects of rights; therefore, violence against women results in a natural lack of access to the city and public space. On the methodology, the research is qualitative and multidisciplinary. It has a legal sociological profile and involves inductive and deductive reasoning. The theoretical methodological framework is the Critical Theory of the capitalist society and Law. The primary sources consist in books and papers from the fields of Law, Politics, Sociology and Urbanism, examined through the techniques of bibliographical review and documentary analysis.
