The article aims to verify the treatment given to the right to privacy in the evolution of the jurisprudence of US Supreme Court and in the Federal Constitutional Court of Germany, analyzing the compatibility with the Brazilian legal system and discussing the bases for the persuasive use of foreign law by the courts.
