Research on Management of the Design Patent: Perspective from Judgment of Design Patent Infringement

This paper attempts to use the infringement judgement of design patent as a perspective, through analyzing the process of design patent infringement and the recognized standard general, The authors propose that the effective way to solve the problem that current management is not standardized should be based on innovation theory, abandon similar products identified as infringing the premise, identify whether there is aesthetic sense as the standard, and bring establishing partial design patent system into the scope of patent management.
