COMPREHENSIVE PROTECTION OF CHILDREN AND ADOLESCENTS AGAINST VIOLENCE: NEW CONSIDERATIONS ABOUT THE AGE IN CRIMINAL LAW

The Criminal Law plays, in general, a secondary and modest role in the field of child protection. However, due to the vulnerability of this collective, the Penal Code contains many provisions which are oriented to the safeguard of their interests, both in the general and the special part. This paper carries out a regulatory analysis of the current legal framework and the proposals contained in the preliminary draft of the Organic Law of Comprehensive childhood and adolescence protection against violence, which has been presented in 2019. For this purpose, we will assume a systemic approach that takes into account the recommendations of the Committee on the Rights of the Child, as well as the interdependence and complementarity between the child protection and reform system and the criminal protection system provided to them.
