Preventing and combating trafficking of juvenile in the european union. critical observations

In this paper are examined the provisions governing the prevention and combat of trafficking in children under the Directive 2011/36/EU of the European Parliament and of the Council on preventing and combating the human trafficking and protecting its victims as well as some provisions on the same subject in the Romanian law. This paper is a continuation of other studies and articles published on the subject in professional journals or proceedings of domestic or international conference. In addition to examining European and Romanian provisions in the field, including the comparative examination, the results are materialized in the critical approach of some European and national provisions. Our approach can be useful to academics, practitioners in the field, especially to the Romanian and European legislators, the ultimate goal being to improve the legal system in the field. The value of this work consists of a critical review of the existing incrimination texts and in the proposals of the law ferenda designed to help mitigate the effects of organized crime activities in this particularly sensitive area.
