LEGAL VALUES IN THE CONTEXT OF CONSTITUTIONAL AND LEGAL POLICY OF MODERN STATES

摘要
Modern globalization processes in the field of law affect the transformation of national legal systems. Changes occur not only at the regulatory level but also at the level of legal awareness of citizens by improving the paradigm of legal understanding. Legal values are of particular importance since modern states can preserve their identity in the globalized world precisely through the national concept of constitutional and legal values, which is intended to reflect the priority areas of their development. That is to say, the national interests of each State should become the criterion for the formation of the system of constitutional and legal values. The article analyzes the essence of the concept of value and the differences between the concepts of value of law, values in law, and legal values. It is argued that legal values are embodied in legal principles and norms. The dialectic of legal values can be traced to the example of such basic values as freedom of election, speech, and religion. Hence, the article aims to define and substantiate legal values in the context of the implementation of the constitutional and legal policy of modern States. The article establishes that legal values constitute the quinta essentia of the content of legal principles and norms which are the form of embodiment and implementation of the State's constitutional and legal policy. The fundamental nature of legal values is that they mediate the content of a particular State's constitutional and legal policy. The authors establish that this policy determines the development trends not only in constitutional relations but also substantiates the constitutional strategy for improving the entire system of national legislation, where the priority should be given exclusively to national interests.
