摘要
Research in the last decade has focused on the accelerated aging of the population as a global phenomenon, a demographic reality strongly present in our country. This context has imposed the realization of scientific investigations that propose mechanisms of confrontation and protection of the consequences that this generates at a social and individual level, which is why the legal sector has focused on the elderly as a subject of rights, in order to provide you with effective tools to assess your independence, social participation, care, autonomy, self-support, personal fulfillment, employment, education and economic security. Such motivation provoked the present study, which aims to justify the need for the creation and regulation of the so-called-reverse mortgage-; institution oriented to the protection of the elderly sector that has a home as part of their assets that, offered as collateral, seeks to obtain income in relation to its value, without the need to abandon it or live with strangers. This is obtained through the analysis of the national context of access to credit, the terminological delimitation of the institution and the assessment of its applicability to the national territory. Its main results consist of obtaining a solid proposal of effective means of self-support for the elderly, capable of alleviating their monetary deficiencies, at the same time as strengthening their individual autonomy and self-satisfaction of their material needs, contributing to the support of the State spending on the protection of vulnerable sectors.
