Enforceability of Economic, Social and Cultural Rights: An Analysis from the Right to Education in Ecuador

摘要
In 1948 the General Assembly of the United Nations Organization put into effect the Universal Declaration of Human Rights. To make it easier for citizens to exercise and demand these rights, they were divided into two large groups: civil and political and economic, social and cultural. The objective of this text is to analyze the level of enforceability of economic, social and cultural rights and particularly, the level of realization of the right to education in Ecuador. For this, the bibliographical research method was adopted to record the main historical milestones in the establishment of rights in general and of the second group in particular. As a result, it is found that economic, social and cultural rights are less enforceable than civil and political rights. It is concluded that each country has undertaken legal reforms that make them enforceable according to the scope of their rule of law and the political class that governs in each period.
