Fostering Smart Startups and Cities in the Scope of Public Innovation Policies

摘要
This article aims to analyze the promotion of Startups from the context of Complementary Law n(degrees) 182/2021, the Legal Framework for Startups (MLS). And it consists of an exploratory and bibliographic research of the legal aspects of the Legal Framework; the characteristics of Innovative Solutions Contracts by the State and their relationship with Law No. 14,133/21; of the MLS in the context of the Digital Transformation Plan (Decree n(degrees) 10.332/20); the promotion of Startups as a possible tool for the implementation of the Smart Cities concept in Brazil; and judicialization, within the scope of the Superior and State Courts, based on the terms "Smart City", "Smart Cities", "Smart Cities", "Startups legal framework" and "LC n(degrees) 182". As a result, a technological innovation was attributed to MLS as a characteristic of Startups' performance; that the Brazilian Charter for Smart Cities points out, among the objectives outlined, as Startups allied to municipal management. And in the jurisprudential research, it was verified that the results found that the merits of the disputes had as their core the offense to the private competence of the Union (art. 22, XXVII, of CF/88); the norms of the Minas Gerais State Constitution and the rules of the bidding process.
