More than environment crimes: the criminal prosecution of legal entities in Brazil

The text addresses the legal personality and capacity for action of legal entities through the theoretical substrate of the significant conception of action of Tomas Salvador Vives Anton and its alignment with the premise of legal personality inherent in the corporate entity. In this step, we have that the corporate entity has the capacity to act and, consequently, to commit offenses beyond the criminal types brought by the Brazilian environmental law. The methodology used will be a bibliographic review, aiming to demonstrate the possibility of the legal entity to commit offenses outside the environmental scope in the Brazilian context.
