FINANCIAL SETTLEMENTS IN INVESTMENT ACTIVITY: INTERNATIONAL LEGAL EXPERIENCE OF REGULATION AND CRIMINAL LEGAL PROTECTION

International experience shows that the development of investment activity and the implementation of investment projects in most countries of the world provides an opportunity to expand and deepen the process of capital reproduction, which affects the growth of the economic and social potential of a country with a market economy. In addition, it is important to ensure criminal legal protection of investment relations. The purpose of the work is the analysis of international legal experience regarding settlements in the field of investment activity, the peculiarities of their criminal law protection, as well as the formation of understanding regarding the perspective directions of reforming settlements. The research methodology consists of such methods as the method of theoretical generalization, the method of comparison, the method of scientific abstractions, the system method, the method of logical analysis, methods of logical generalization, the method of multifactorial econometric analysis, and the hypothesis method. With the help of the conducted research, the characteristic features and trends of regulation of foreign investments in different regions of the world were highlighted. Peculiarities of regulation of investment activities abroad, as well as mechanisms for ensuring criminal protection of investments were considered. The ways of creating an effective state policy of these countries regarding the activation of investment activities and the creation of a favorable investment climate and the role of peculiarities and convenience of settlements in this matter are analyzed.
