From absolute property to the commons: Legal perspectives in Quebec civil law in light of Italian lessons

摘要
The concept of the commons has taken on an increasingly important place in the legal sphere over the past thirty years. The Italian beni comuni experiences in Italy undoubtedly stands out as encapsulating the theorization of the concept. The management of the movement takes various forms, shaped by the actions of citizens and by drawing on civil law as needed on a case-by-case basis. This paper serves as a starting point for a broader reflection on the form that the commons can take as well as on their place in the Quebec legal framework.
