摘要
The article problematizes the legal criteria that guide the distinction between the public and private nature of the documents produced by the Brazilian presidents. It shows that there are ambiguities in the current legislation that have an impact on the preservation of part of Brazil's documentary heritage. The reflections undertaken point to the importance of the participation of archivists in the debates on the document collections of the presidents of the Republic, to resolve the inaccuracies.
