摘要
This paper aims to establish the scope of the right to information that media has and its possible implications on due process of people who are criminally involved in ongoing proceedings. When information is improperly disclosed, that is, without any kind of limitation or not following any specific judicial proceedings, due process can be compromised affecting trial processes and the rights of the accused. In order to achieve the above mentioned goal, a review of the concepts and scope of the right to information, seen from the standpoint of publicity and due process' principles, will be performed. For the latter, there will be an emphasis on the presumption of innocence tenet. Subsequently, the dispute between media and people criminally implicated will be analyzed.
