Legal Discourse and Legal Consciousness: An Outline of Philosophical Foundations of Legal Hermeneutics

摘要
In the following study author explores the issue of the status of legal discourse: a specific type of language in legal speech and texts (acts, legal rules). Rather than proccessing an inquiry about modes of manifestation of legal discourse the author questions the method of interpretation best suited for efficient aknowledgement and understanding of legal discourse. Therefore he suggests the use of hermeneutical interpretation on basis of successful adaptation of said method in Paul Ricoeur' s interpretation of speculative-philosophical discourse. An occurence of creative dynamics - established via the effects of figures of speech and virtual anomalies in language - which supplement philosophical, humanistic and legal discourse with new and surprising meanings, convinces him of adequacy of such approach. A scheme which enables and decisively affects legal discourse also begins to unveil: a concept of consciousness of law and social justice.
