THE REGULATION OF THE FACTOR OF SUSTAINABILITY AND OF THE INDEX OF REVALUATION OF THE SYSTEM OF PENSIONS OF THE SOCIAL SECURITY AFTER COMING INTO FORCE THE OPTIONAL PROTOCOL TO THE CONVENTION OF ECONOMICAL, SOCIAL AND CULTURAL RIGHTS

This work focused on the combined analysis of two events that have happened in 2013: on one hand, the recent coming into force in Spain of the Optional Protocol to the Convention of Economical, Social and Cultural rights. It is remarkable that this Protocol allows individual or groups of citizens to denounce the violation of the rights protected by the Convention. On the other hand, the up-coming Law about the Factor of Sustainability and of the Index o Revaluation of the Spanish public pensions, which is going to introduce important changes of the calculation of pensions and of its revaluation. If this modification is in accordance with the Spanish Constitutional Court's doctrine and with the interpretation of the right to social security contained in the Convention will entertain the next pages.
