Law in the sphere of medical safety in the context of a constitutional right of health protection

摘要
The article considers the safety problem (particularly, drug safety) in terms of the constitutional law on health protection, for realization of which it is necessary to create safe conditions. Medical activity (medical care, medical services, clinical trials) is the way of implementation of the specified right, but it can become "unsafe" when the sources of increased danger are used. Among them the drugs (which are harmful and not completely under control of the person) occupy not the last place because of negative consequences of their usage. Therefore it is important to settle the problem of drug safety legislatively. The article points that the legislation in the field of drug safety ensuring can include the legal acts on health protection and on drug circulation. Therefore, legislation improvement in the field of drug safety ensuring can be executed both in creation of legal conditions for safe medical activity, and in formation of the legal framework for production and distribution of safe drugs. Consequently, all these actions can promote safe conditions for realization of the constitutional law on health protection.
