ALIGNMENT OF CONSTITUTIONAL PROVISIONS, LABOR AND BANKRUPTCY DISCHARGE IN FRONT OF TARGET BUSINESS CRISIS AS A RESULT OF GLOBALIZATION

This present article constitutes a research piece based on the project denominated "Harmonization of the constitutional, labor and bankruptcy law", against the objective dismissal of workers due to a business crisis, as a globalization effect. This research is funded by the Corporacion Universitaria de la Costa "CUC". The work analyzes the constitutional, labor and bankruptcy law that tend to protect workers against layoffs conditioned by an "objective reasoning" of companies in crisis as a result of the globalization, as well as the owners of the means of production, with the objective of warning about the existence of a harmonic articulation between the aforementioned bodies of law and the degree by which these bodies withstand the efficiency test proposed by Bobbio in his major work: "A Theory of the Legal Order: Justice Validity and Effectiveness".
