Legal considerations on migrations in Cuba. A proposal for the regulation of human trafficking and migrant smuggling crimes

In the current context migrations occupy a significant place in human relations because of their economic, psychological, sociological and legal consequences. This paper aims to argue the legal impact of migration in Cuba taking into account the current regulation of the crimes of people trafficking. Theoretical and empirical methods were used, which allowed to reach transcendental results not only for the science of law, but also for demographic analysis and population studies in Cuba. A diagnosis which included the application of interviews, document review and scientific observation to oral trials in criminal matters was made. As main result was obtained the proposal of three theoretical assumptions for proper legal regulation of migration in the Cuban Penal Code, particularly the one related to the intervention of third countries, the conception of the profit and the people trafficking as a figure of crime.
