Global justice and legal justice: do we have the right to a fair world?

摘要
Article 28 of the Universal Declaration of Human Rights declares that "everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized." This essay does not try to make a dogmatic comment of that article but to take it just as a pretext to uphold a thesis on the idea of global justice. The conclusion will be that article 28 my and must be interpreted in such a way as formulating with clarity enough a moral right which every person is entitled to, whose fulfilling requires a new global order and, at the same time, is a necessary condition of global justice. It shall be analyzed how are nowadays presented the claims for global justice, expanding on two provinces, that of poverty and that of environmental degradation, the oldest and traditional claim for peace. I shall argue that all these claims may be answered in three different levels and that only in one of them the answer is properly aroused as an exigency of justice and that when it is set up in this way, it requires a new universal legal order with some determined features.
