International Humanitarian Law and the Protection of Children in Armed Conflicts situations in Democratic Republic of Congo

摘要
The present thought has as an inner interest, the analysis of the particular protection of children in armed conflicts situations, to the conventional plan and its implementation on the battlefield in Democratic Republic of Congo. It is clear that the protection of the child, which is said special and particular in armed conflict is not the same in legal plan and in reality. On the legal plan, the conventional texts that guarantee the child protection in armed conflicts situations do not all express in the same way, in order to foresee certain profitable appreciation margins to the States or conflicts part. That put the child in a permanent situation of justified insecurity. Instruments related to the human rights, also seen to fill certain deficiencies of international humanitarian law. On the battlefield, the warring nations are not upset to violate those different legal instruments. To reach the efficient and effective implementation, compared with the conflicting situation in Democratic Republic of Congo, this dissertation suggests the creation of a national Commitee for the Implementation of International Humanitarian law, followed with a National Committee for the Implementation of International Humanitarian Law, followed with a National Committee of the Compensation of Victims; a Strategic Studies Center of Armed Conflicts and the establishment of International or Mixte ad hoc, Criminal Courts.
