Effects of litigation on health and equity: The case of the Province of Buenos Aires, Argentina

摘要
Most of the literature about right-to-health litigation in Latin America understands that both actors and objects of the litigation are representative of middle and upper classes, while vulnerable population fall outside the litigant universe. However, recently it has also been suggested that these effects depend on the particular national context in which this litigation is initiated. This emphasizes the importance of this tool as guarantee of the right to health of the most vulnerable. Our work seeks to analyze this problem in the case of Argentina and particularly the case of health litigation in the Province of Buenos Aires. The results show a partial confirmation of the thesis of the distortionary effects of health litigation in our countries.
