RESTORATIVE JUSTICE AND FAMILY CONFLICT RESOLUTION

This scientific paper aims to analyze the topic of Domestic Violence and the possibility to resolve familiar conflicts by means of the Restorative Justice. As problem, we have: is it possible to solve familiar conflicts derived from domestic violence through the Restorative Justice? It is believed that the answer is affirmative. Therefore the objective of this research is to observe if the Restorative Justice is a new way to resolve familiar conflict, since it's using would encourage dialogue. That's because, in many familiar conflicts, the presence of a mediator would be enough to ease conflicts, excluding the necessity of passing it through the Judiciary System, which, in many times, is slow and inefficient, since it only punishes instead of restoring the relationships. For that, by inductive method and bibliographic research, it is found the possibility of the use of Restorative Justice as a way to attenuate the problems with prison system in Brazil. Familiar conflicts can be solved by aiming the reestablishment of the family bond (the relationship). However, when this way doesn't prove itself effective, the victim must have the right to seek justice through traditional methods. The main point is, at first, to try to resolve the conflict as painless as possible, but if not, that the legal system shall be prepared to face these challenges to bring justice to the victims and to the offenders.
