Deletion of personal data on the internet: The recognition of the right to be forgotten

This article discusses the existence of a right to be forgotten on the Internet based on the Chilean regulation and, specifically on the analysis of the Law 19.628 about the Protection of Privacy. Additionally, it examines the criteria that the international and national jurisprudence have established, particularly those concerning the role of on-line press archives as well as those who which have recognized the existence of the right to be forgotten on the Internet (Court of Justice of the European Union). Finally, the article also analyzes the problem of establishing a general obligation of deletion of personal data from the Internet, especially for potential violations of rights such as freedom of speech and expression.
