Judicialization of Politics: a Political or a Juridical Phenomenon?

摘要：
The objective of this article is to analyse the judicialization of politics, showing that it is not just a Brazilian phenomenon. Besides that, this phenomenon is being very criticized, especially by academic scholars. In order to accomplish that, the article analyses the judicial restraint theory, which defends a deference of political questions, that should be decided by the elected Powers. Nevertheless, it is demonstrated, with the statistics, that the judicialization of politics in Brazil, with the transference of the political decisions to the Federal Supreme Court (Supremo Tribunal Federal), is caused by the political actors, as political minorities.
