Legal Security, Rights and Needs

The ideology of the state reform in Argentina and the techniques applied (modernization, flexibility, deregulation) is summarized in the phrase "less government", which translates into "less law", "fewer guarantees", "less governament Social Law". The "Reform of the State" and "return to the market" in Argentina was in order to resolve problems associated with the deficit of public finances and the external and internal debt. Administrative techniques used gave greater benefits to investors and companies and weakened the position of the most disadvantaged sectors of society. No account was taken of the protection system needs, and therefore did not contribute to giving greater certainty to benefit the rights recognized in our Constitution and International Law of Efuman Rights. The regulatory paradigm applied (economic regulation) should be displaced by the paradigm of "social regulation" to provide legal certainty and efficiency to the care system needs.
