摘要
This article focuses how the concept of constitution was understood in Brazil before independence. The idea of a "social enginery" that support changes both in the state and society, is usually a derivation, in a very schematic way, of rationalist mecanicism and newtonian physics. Variations of liberalism and its brazilian receptions, in a country with strong colonial features, generate singular deals of innovation and archaism. It becames a kind of "mystical constitucionalism", that early strikes with social and political reality.
