Procedure and procedural the Hague Convention on civil aspects of international abduction of children

This study of the problem characterized by the absence of a document available pragmatically on the applicability of the Hague Convention on Civil Aspects of International Child Abduction, 1980, the Brazilian legal system. In pursuit of essentiality to pay attention to the complexities of this issue, work has as main objective to analyze the Brazilian legal system, in the light of doctrine and law, the effectiveness of the mechanisms of the Hague Convention on Civil Aspects of International Child Abduction, 1980, both in active cooperation (when the Brazilian Central Authority asks the central authority of another Member State to carry out civil procedure for the child's return removed or retained illegally) and in passive cooperation (it is shown by performing acts public by the Brazilian Central Authority, at the request of the Central Authority of another State Party to the realization of the international abduction of a child victim of return held in the country). Furthermore, we analyze the Spanish legal system in the light of the legislation, mechanisms of effectiveness of the Hague Convention on Civil Aspects of International Child Abduction, 1980.
