Reparation for pain and trauma subjectification by armed conflict victims

摘要
The extradition of perpetrators of the Colombian armed conflict has tarnished the access of victims to truth, justice and reparation. This negotiation process ruled on justice and peace has left unpunished crimes against humanity, however the State tries to compensate damage caused to victims but individual pain for losing his/her beloved object is not repaired with money, still above law that legitimizes. To subjectivize a trauma, Diaz (2001) says that "A relationship between man and death varies depending on who is dying and how someone dies",but State criteria is different and takes other attributes of situation as a reference because we could say that armed conflict victims are not law subjects but compensation objects legitimized by State through justice and peace law. This paper is to focus attention on this issue related to subjective processing of trauma which demands a proper attention to victims by armed conflict.
