First ever appeal under section 110 of the UK Water Resources Act 1991

This paper presents details of a 5-year battle against drainage authorities, which were opposed to the restoration of an argae (Welsh for flood embankment) to protect a grade II* listed Elizabethan half-timbered building as well as farm buildings, access road and agricultural land from the floodwaters of the River Severn. By the first ever appeal undertaken in accordance with section 110 of the Water Resources Act 1991 they were found to have acted not only unreasonably but also unlawfully.
