摘要
This article reviews the first seven years of the operation of the Human Rights Act 1998 (UK) and compares it with the Charter of Human Rights and Responsibilities Act 2006 (Vic), which comes fully into force on 1 January 2008. It considers in particular the courts duty to interpret legislation compatibly with humen rights; the effect of the new measures on judicial review, especially in the field of personal liberty; and the position of non-governmental public authorities. It suggests some reasons why the Human Rights Act has been coolly received by the general British public.
