Human rights violations monitoring and the problem of selecting rights: reflections on the limits of the human rights theory

This article is a result of the actual experience of human rights monitoring, which included the preparation of the 5th National Report on Human Rights of the NEV / USP and the problem of the selection of rights that came along with those activities. The theory of human rights does not provide sufficient theoretical tools for the researcher or the human rights activist to solve this problem. The classical distinction between civil and political rights / social, economic and cultural rights and the principle of indivisibility of human rights were used in an exercise of sociological analysis, which sought to point out the limits and the blind spots of those ideas as analytical categories.
