摘要
The article outlines a possible elucidation of the phenomenon of human rights from the perspective of philosophical anthropology. This paradigm (Scheler, Plessner, Gehlen, Cassirer) expounds "eccentric positionality" as the conditio humana between hominitas and humanitas. Within in this framework, it discusses the following aspects of human rights: 1) the humanitas of human rights as a response to the problematic potentials of hominitas; 2) the diversity of human rights-their antinomic or pluri-nomic structure; 3) the unity of the various human rights in human dignity, in which the four "worlds" of the human life-world-outside world, inside world, co-world, symbolic world-are brought into a balanced exposition; and 4) the legal realisation of human rights through practices of power, democratic sovereignty and physical violence.
